SUMMARY:Resigning Teacher Union Membership and Stopping Union Fees
DESCRIPTION:Today\, we are joined by Milton Chappell from the National Right To Work Foundation\, who will elucidate the processes involved in ceasing union dues across various educational institutions\, including public schools\, charter schools\, and private schools. \nWhile the procedures vary depending on the type of school\, the fundamental step in union resignation is to assess the funding source of the institution. \nMr. Chappell will guide us through the most prevalent scenarios and address any inquiries you might have. \nWe invite you to participate in today’s session and encourage you to share the video link with colleagues contemplating union resignation. \nAs an authority on the subject\, Mr. Chappell’s expertise is evident from his extensive list of publications and legal cases\, many of which pertain to educators. \nSelected Publications:\n– “Protecting the Rights of State Employees Against Compulsory Unionism\,” featured in California Public Employee Relations\, Issue No. 143 (August 2000).\n– “Legislative and Practical Alternatives to the Current Monopoly Bargaining Model That Will Enhance the Viability of Independent Teacher Groups\,” published in Government Union Review (Summer 1995).\n– “From Abood to Tierney: The Protection of Nonunion Employees in an Agency Shop: You’ve Come a Long Way\,” Ohio Northern University Law Review\, Vol. 15 (1988). \nNotable Cases (selected):\n– Davenport v. Washington Education Association\, a landmark decision by the U.S. Supreme Court in 2007.\n– Otto v. Pennsylvania State Education Association\, adjudicated by the Third Circuit Court of Appeals in 2003.\n– Damiano v. Matish\, a significant case from the Sixth Circuit Court of Appeals in 1987.\n– Swanson v. University of Hawaii Professional Assembly\, decided by the District Court of Hawaii in 2003.\n– Leer v. Washington Education Association\, a case from the Western District of Washington in 1997.\n– George v. Baltimore City Public Schools\, a case from the District of Maryland in 1987.\n– FEC v. NEA\, a case from the District Court for the District of Columbia in 1978.\n– Elvin v. Oregon Public Employees Union\, a case from the Oregon Supreme Court in 1992.\n– Albro v. Indianapolis Education Association\, a case from the Indiana Court of Appeals in 1992\, affirmed by the Indiana Supreme Court.\n– Ball v.
